The Trump administration has opened a new front in its campaign against race-conscious policies in American education by proposing new rules that could threaten the tax-exempt status of schools that provide targeted benefits to Black and other minority students.
Under the new proposal, the Internal Revenue Service would be allowed to challenge the tax-exempt status of private schools that provide benefits or opportunities based on race. According to The New York Times, the administration argues that institutions receiving tax advantages should not engage in programs that discriminate based on race.
The tax exemption proposal expands the administration’s broader effort to dismantle diversity, equity and inclusion programs across American education. For schools, the stakes could be substantial. Tax-exempt status is an important part of the financial structure of private nonprofit institutions, affecting their tax obligations and the treatment of charitable contributions.
If finalized, the rules could influence how private colleges structure scholarships, recruitment, mentoring and other programs aimed at expanding opportunities for historically underrepresented students. For Black communities, the issue is particularly significant. Higher education remains one of the major pathways through which racial and economic inequalities can be challenged.
The administration maintains that schools can still pursue race-neutral approaches, including programs based on economic disadvantage or other non-racial criteria. The proposal is not yet a final rule. Schools and other stakeholders will have an opportunity to respond before the administration determines whether and how the measures will take effect.
